Public Offer Agreement

This Public Agreement for paid services (hereinafter — the Agreement) is an adhesion contract defining the procedure for providing consulting, informational, creative, individual and group services, leisure activities, as well as rights, obligations, and relations between the individual entrepreneur Liudmila Vikol, Registration No. NA3410696 (hereinafter — the “Contractor”), and an individual person (hereinafter — the “Customer”) who has accepted this public offer by making payment.

1. DEFINITIONS

  1. Agreement — a contract entered into upon payment by the Customer.
  2. Offer — this publicly posted document. Its publication on www.lumi.by constitutes a public offer addressed to any person.
  3. Acceptance — the full and unconditional acceptance of the Offer by making payment.
  4. Price List — the list of services and prices published at www.lumi.by.

2. SUBJECT OF THE AGREEMENT

  1. The Contractor undertakes to provide paid consulting, informational, creative and leisure services, and the Customer undertakes to accept and pay for such services.
  2. The Contractor may amend the Agreement, and the Customer must review the current version before receiving services.

3. ACCEPTANCE AND PAYMENT

  1. This Agreement is a public contract under Belarusian civil law.
  2. Posting the Agreement on www.lumi.by constitutes an offer.
  3. The Customer enters into the Agreement by full adhesion without reservations.
  4. Acceptance is confirmed by payment.
  5. The Agreement is considered concluded in writing upon payment.
  6. The Agreement is valid in the version effective at the moment of payment.

4. RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1. The Contractor shall:

  • provide services within agreed terms;
  • provide accurate information regarding services.

4.2. The Contractor may:

  • engage third parties;
  • demand compliance with safety rules;
  • seek compensation for damages caused by the Customer.

4.3. The Customer shall:

  • follow safety and conduct rules;
  • compensate damages caused to the Contractor or third parties;
  • comply with the Agreement.

4.4. The Customer may:

  • demand proper provision of services.

5. COST AND PAYMENT TERMS

  1. The cost of services is determined according to the Price List.
  2. The Customer bears all payment-related expenses.
  3. Services are provided only after the Contractor receives payment confirmation.
  4. Services must be paid in full in advance.

6. ACCEPTANCE OF SERVICES

  1. No service acceptance certificate is issued.
  2. The fact of service consumption confirms service delivery.

7. LIABILITY

  1. Liability is determined according to Belarusian law.
  2. The Contractor is not liable for:
    • injuries caused by Customer’s violation of safety rules;
    • discrepancies between expectations and results;
    • damage caused by third parties.

8. TERM AND TERMINATION

  1. The Agreement is effective from the moment of payment until full provision of services.
  2. Refunds are not provided once services have been rendered.

9. OTHER TERMS

  1. All information related to the Agreement is confidential.
  2. The Agreement and the Price List form a single contract.
  3. The Parties acknowledge the legal force of this text.
