Privacy Policy

This Privacy Policy (hereinafter referred to as the Policy) describes the procedures for collecting, storing, processing, and protecting personal data that may be obtained from the User by the individual entrepreneur Liudmila Vikol (hereinafter — the Photographer, Website Administration, Operator) when using the website lumi.by and its subdomains.

1. Terms and Definitions

For the purposes of this Policy, the following terms shall have the meanings specified below:

  1. Website Administration — the individual entrepreneur Liudmila Vikol and/or persons authorized by her to manage the website, determine the purposes and methods of personal data processing.
  2. Personal Data — any information relating to an identified or identifiable individual.
  3. Processing of Personal Data — any action or set of actions performed on personal data, including collection, recording, storage, updating, use, transmission, blocking, deletion, or destruction.

2. General Provisions

  1. By using this website, the User agrees to the terms set forth in this Policy.
  2. If the User does not agree with the terms of the Policy, they must discontinue using the website.
  3. This Policy applies exclusively to the website lumi.by and its subdomains.
  4. The Website Administration is not responsible for third-party websites that the User may access through links on lumi.by.
  5. The Website Administration does not verify the accuracy of personal data provided by the User.

3. Subject of the Policy

  1. This Policy defines the obligations of the Website Administration to protect the personal data provided by the User when:
    • submitting forms on the website,
    • requesting service pricing,
    • booking a photoshoot,
    • or contacting the Photographer through any communication channels.
  2. The personal data processed within this Policy may include:
    • first and last name,
    • phone number,
    • email address,
    • other information voluntarily provided by the User.
  3. During website usage, the following data may be collected automatically:
    • IP address,
    • cookie data,
    • browser characteristics,
    • time of access,
    • referral source (previous page address).
  4. Disabling cookies may limit access to certain website features.
  5. All other personal data not listed above shall be securely stored and not disclosed except as required by this Policy.

4. Purposes of Processing Personal Data

Personal data may be processed for the following purposes:

  1. User identification when placing a request for services.
  2. Providing access to personalized website content.
  3. Establishing feedback, including notifications and inquiries related to services.
  4. Verifying the accuracy of personal data.
  5. Creating and managing service bookings.
  6. Informing the User about the status of their request.

5. Methods and Terms of Personal Data Processing

  1. Personal data is processed in accordance with the legislation of the Republic of Belarus, without time limitation, using any lawful method, with or without automated tools.
  2. Personal data may be transferred to third parties solely for fulfilling obligations to the User, including:
    • delivery services,
    • telecommunication operators,
    • payment systems.
  3. Personal data may be provided to government authorities of the Republic of Belarus only when required by law.
  4. In the event of loss or unauthorized disclosure of personal data, the Website Administration shall notify the User.
  5. The Website Administration undertakes necessary technical and organizational measures to protect personal data from unlawful or accidental access, modification, destruction, distribution, or other unauthorized actions.
  6. The User and Administration shall jointly take measures to prevent potential losses arising from personal data disclosure.

6. Rights and Obligations of the Parties

User Obligations:

  • to provide accurate and up-to-date personal data;
  • to update personal data in the event of changes.

Website Administration Obligations:

  • to use personal data exclusively for the purposes specified in Section 4;
  • to maintain the confidentiality of personal data;
  • to protect personal data from unauthorized access and other unlawful actions;
  • not to transfer data to third parties except in cases defined by this Policy;
  • to block personal data upon User request during verification.

7. Liability of the Parties

  1. The Website Administration shall be liable for damages incurred by the User due to the unlawful use of personal data, in accordance with the laws of the Republic of Belarus.
  2. The Website Administration shall not be liable if personal data:
    • was publicly available before its disclosure,
    • was lawfully obtained from a third party,
    • was disclosed with the User’s consent,
    • was compromised due to actions of third parties (hacking, malicious software, etc.).

8. Dispute Resolution

  1. Prior to initiating court proceedings, the User must submit a written claim to resolve the dispute amicably.
  2. The Website Administration shall review the claim within 30 calendar days.
  3. If no agreement is reached, the dispute shall be referred to the competent court in accordance with the laws of the Republic of Belarus.
  4. The applicable law for this Policy is the legislation of the Republic of Belarus.

9. Additional Provisions

  1. The Website Administration may amend this Policy without obtaining User consent.
  2. The updated version becomes effective upon publication on the website lumi.by.
  3. Questions related to the Policy may be submitted to the email address of the Website Administration.
